Child Legal Representative (CLR) 

In Colorado, the legal standard for family courts make decisions about parenting issues is typically based on what is in the best interests of the children. The CLR actively participates in all aspects of the case, which includes conducting an investigation. The court carefully considers the CLR’s recommendations, along with other evidence presented, in making a final judgment. While the weight given to the recommendations varies case-by-case, a well-presented and compelling argument on behalf of the child carries significant influence.

Definition and Legal Authority for a Child Legal Representative

Colorado Revised Statutes 14-10-116  describes the CLR’s role and powers. The law authorizes the court to appoint a CLR in custody cases where the child’s best interests require independent representation. Unlike attorneys hired by parents, the CLR doesn’t take instructions from the child but instead evaluates the overall situation and advocates for outcomes that safeguard the child’s welfare.

Difference Between CLRs, Guardians Ad Litem, and Child and Family Investigators

Parents sometimes confuse a CLR with other court-appointed professionals. Key differences include:

  • Child Legal Representative (CLR): Licensed attorney who advocates in court for the child’s best interests, participates in hearings, and can cross-examine witnesses.
  • Guardian ad Litem (GAL): Appointed typically in Title 19 Juvenile cases.
  • Child and Family Investigator (CFI): Neutral evaluator who investigates custody issues and submits a written report but doesn’t advocate in court.

While CFIs and PREs conduct evaluations and provide reports to the court, CLRs offer continuous legal representation for the child throughout the case. This ongoing involvement allows CLRs to adapt to changing circumstances and advocate for the child’s needs in real-time, providing a dynamic and responsive approach to child advocacy.
